Measures to Improve Compliance and Minimize Risk of Port State Control Detentions
TO: ALL SHIPOWNERS, OPERATORS, MASTERS AND OFFICERS OF MERCHANT SHIPS, AGENTS AND RECOGNIZED ORGANIZATIONS
SUBJECT: Measures to Improve Compliance and Minimize Risk of Port State Control Detentions
Reference: (a) SOLAS, Chapter I, Regulation 11
(b) IMO Resolution A.1138(31) - Procedures for Port State Control
PURPOSE: This Notice establishes measures to improve the reporting of deficiencies in accordance with reference (a) to monitor compliance and minimize risk of Port State Control (PSC) detentions of Liberian flagged vessels.
APPLICABILITY: This Notice applies to Owners, Operators, Masters, Ship Officers and Recognized Organizations (ROs) of Liberian flagged vessels.
REQUIREMENTS:
1.0 Measures
1.1 From January 15, 2021 the following requirements will apply to all Liberian Flagged vessels:
1.2 Ref (a) requires reporting of accidents and defects which affect the safety of the ship or the efficiency, completeness of its life-saving appliances amongst other equipment. Reports include deficiencies noted during PSC Inspections. In order to expedite the
receipt of this information, the Administration requires all Masters, Owners, Operators, DPA and ROs to immediately send all PSC inspection reports to our Fleet Performance Department, at PSCfollowup@liscr.com.
1.3 The Administration also requires submission of a Corrective Action Report, if deficiencies are discovered during a PSC Exam. The Corrective Action Reports shall be submitted as soon as possible and no later than 30 days from the date of the PSC Inspection. Vessel operators are requested to send the Corrective Action Reports to PSCfollowup@liscr.com.
Vessel Operators may submit Corrective Actions Reports using the following means:
(1) Form RLM-031, Rev.04/2020. This form is available for downloading on the Administration’s website at: https://www.liscr.com/sites/default/files/RLM-031_Rev.04-2020.doc
(2) The format used by the company safety management system; describing the deficiencies, corrective actions, root cause analysis and preventive actions taken.
2.0 Safety Management System (SMS)
2.1 The requirements in 1.2 and 1.3 shall be incorporated into the company’s Safety Management System (SMS) for all vessels, at the earliest opportunity, however no later than July 1, 2021.
3.0 Verification
3.1 Liberian Nautical Inspectors and Auditors will begin verifying compliance with requirements listed to items 1.2 and 1.3. during Annual Safety Inspections (ASI) as of January 15, 2021.
A finding may be issued if a vessel is found to not be within compliance.
